Shipping and Returns Policy
Product Availability
All orders placed are subject to product availability. Should any item be unavailable or out of stock, the Customer shall be notified immediately and shall be reimbursed, within the following days, for the amount charged in respect of the unavailable and undelivered item, using the same payment method used for the purchase
Shipping and Delivery Costs
Pacha Merchandise, S.L. shall use its best efforts to deliver the products purchased by the Customer within a period of between three (3) and ten (10) business days from receipt of the order and confirmation of payment, depending in all cases on the destination country.
Notwithstanding the foregoing, deliveries inevitably depend on circumstances beyond the control of Pacha Merchandise, S.L., such as traffic conditions at certain times or incidents affecting the transport company (including, but not limited to, breakdowns, accidents, strikes, etc.). Therefore, delivery dates shall be considered approximate and indicative only.
In any event, if delivery is delayed, the Customer may contact the designated carrier (through the email containing contact and tracking details received once the shipment has been dispatched), contact the Pacha store at pachashop@pacha.com , or use any of the channels specified under Customer Service.
If the Customer is not present at the address provided for delivery of the order, the carrier may attempt to deliver the parcel to any person present at the premises at the time of delivery. If delivery cannot be completed, an attempt may be made to leave the parcel in a secure location. If neither delivery nor placement in a secure location is possible, the parcel shall be returned to the warehouse of Pacha Merchandise, S.L., and the Customer may contact Pacha Merchandise, S.L. to arrange a new shipment or request the corresponding refund.
If the order has not been delivered for reasons not attributable to Pacha Merchandise, S.L. and, after thirty (30) days, the Customer has neither collected the order nor accepted delivery thereof, the order shall be deemed abandoned. For further information, the Customer may contact Pacha Merchandise, S.L. through the Customer Service channels.
Pacha Merchandise, S.L. shall not be liable for any damage, loss, or incident relating to the parcel once it has been delivered to the address provided by the Customer or handed over to the relevant carrier.
Home deliveries shall be free of charge for orders exceeding EUR [80]. For orders below this amount, shipping costs shall be EUR 4 for deliveries within Spain. For international deliveries, shipping costs shall be those indicated in the order summary page prior to the Customer's confirmation of the order and, in any event, before payment details are entered.
Shipping costs may be amended at any time without prior notice. Any such changes shall apply from the moment the amendment is incorporated into these Terms of Sale. In all cases, the shipping costs displayed at the time the order is placed shall apply.
Right of Withdrawal and Returns
The Customer shall have a period of fourteen (14) calendar days from receipt of the purchased products to exercise their right of withdrawal and return the purchased product(s) without providing any reason.
Where the products included in a confirmed order are delivered separately on different dates, the date of dispatch of the last product shall apply for the purposes of calculating the return period.
To exercise the right of withdrawal, the Customer must notify their decision through one of the following channels:
- 1. By post, by sending a letter to Pacha Merchandise, S.L., Carrer de Canaries 37, Torre 4, Planta 4, Ibiza, 07800, Balearic Islands, Spain.

Where the Customer returns all products included in the order within the first fourteen (14) calendar days following receipt of the last product, all payments received in connection with the purchase shall be reimbursed, including delivery costs (except for any supplementary costs resulting from the Customer's choice of a type of delivery other than the least expensive standard delivery option offered).
Once the Customer has requested a return, the returned order shall be collected by Pacha Merchandise, S.L. through its own logistics transport service and must be accompanied by the return label provided by Pacha Merchandise, S.L., together with the delivery note and, where applicable, the invoice issued by Pacha Merchandise, S.L.
Under no circumstances shall returns initiated online be accepted in physical stores.
The Customer may return any item provided that, for reasons of health protection or hygiene, such item has not been unsealed, exposed to inappropriate conditions, or handled in any manner.
For the purposes of exercising the right of withdrawal, where bundles or product sets have been purchased, such products must be returned in full, with the original plastic seal remaining intact and undamaged.
Refunds shall be processed within fourteen (14) days following receipt of the returned product, including shipping costs (except for any supplementary costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery offered), using the same payment method used by the Customer for the purchase, following examination of the returned item and verification that it is in satisfactory condition.
If the payment method originally used does not permit reimbursement (for example, where the credit or debit card has expired), Pacha Merchandise, S.L. shall contact the Customer to request an alternative reimbursement method.
In connection with promotions such as “Buy One Get One Free” or “2-for-1” offers, partial returns involving only the paid product for the purpose of retaining the free item shall not be accepted.
Return costs shall be borne by the Customer. The return fee shall depend on the country from which the return is made and the type of service selected. In all cases, the Customer shall be informed by the transport company of the applicable return costs before payment is made. Such return fee shall apply to each return request.
Return of Defective or Incorrect Products
In the event of returns due to defective or incorrect products, the Customer shall be entitled either to a refund of the product price or replacement of the product with another in proper condition, without incurring any return costs.
In the event of a refund, the Customer shall be reimbursed for all amounts paid in respect of defective products, including delivery costs relating to the defective items and return shipping costs.
Pacha Merchandise, S.L. shall not incur liability towards the Customer where the product contained in the returned parcel is not the correct product. Notwithstanding the foregoing, where the Customer has mistakenly returned a product different from that included in the order and collection thereof can be arranged, the Customer shall be responsible for organizing such return and bearing the corresponding collection costs.

Liability.
However, and unless otherwise provided by applicable law, Pacha Merchandise, S.L. shall not be liable for the following losses, regardless of their origin:
(i) loss of income or sales; (ii) loss of business; (iii) loss of profits or contracts; (iv) loss of data; and (v) loss of management time or office time.
